Mother of Anna Nicole Smith, Virgie Arthur, lost again · 2007-04-29 12:04
Virgie Arthur lost and Larry Birkhead could soon be back in the U.S. with the baby girl he had with Anna Nicole Smith after a Bahamian court rejected Arthur's last-ditch appeal to stop him.
The judges ruled that a U.S. court would likely have the final say in the custody dispute between Arthur, the 7-month-old baby's grandmother, and Birkhead, who was confirmed as the father after DNA testing.
Arthur was challenging a judge's decision this week to let Birkhead leave the island chain with Dannielynn. Her attorneys argued that Birkhead might not return as directed for another private hearing in the case June 8.
"I’'m happy because this is nonsense really," Birkhead said outside the courthouse.
Birkhead, a 34-year-old Los Angeles photographer, later went to the Nassau registry to pick up a revised birth certificate for Dannielynn, with his name replacing that of Smith's last companion, Howard K. Smith, as the baby'’s father.
The court also ordered Arthur to pay Birkhead $3,000 in legal costs.
